1. Acceptance of Terms
By accessing or using Foilios (“the Service”), operated by Foilios Inc., you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Foilios is a property management platform providing tools for rental operations, accounting, tenant management, maintenance tracking, and related services. The Service is provided “as is” during the beta period.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
4. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Service; (c) interfere with the proper working of the Service; (d) upload malicious code or content; (e) scrape or harvest data from the Service.
5. Data Ownership
You retain all rights to your data. By using the Service, you grant Foilios a limited license to process your data solely to provide the Service. We will not sell your data to third parties.
6. Payment Terms
Paid plans are billed monthly or annually. Payments are non-refundable except as required by law. We may change pricing with 30 days notice. The free tier (up to 20 units) has no payment obligation.
7. Service Availability
We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance. During beta, service interruptions may occur without prior notice.
8. Limitation of Liability
To the maximum extent permitted by law, Foilios shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
9. Termination
Either party may terminate this agreement at any time. Upon termination, you may export your data within 30 days. After that period, your data will be permanently deleted.
10. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use after changes constitutes acceptance.
11. Governing Law
These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
